H-GAC Disaster Recovery Contract Guidance

Background
HGACBuy members have recently inquired as to the eligibility of the previous HGACBuy contracts (Debris Clearance Removal HGAC-CE-2012-10-001and Debris Monitoring HP07-13, HP07-16) for federal funding.  These questions result from an Office of Inspector General (OIG) audit of a single HGACBuy member who utilized the referenced contracts during 2015.  H-GAC responded to the findings noted by the OIG and a determination remains pending. HGACBuy conducted a new procurement in 2017 to address the concerns expressed by OIG.

Current Situation
H-GAC has consulted with a legal expert experienced in FEMA procurement (a former FEMA general council), updated the specifications and solicited new procurements.  H-GAC has new contracts as a result of the new procurement solicitations (HP08-17 All Hazards Preparedness, Planning, Consulting and Recovery Services and DR09-17 Disaster Debris Clearance and Removal Services).  The new procurement solicitations addressed the concerns expressed by the OIG, and placed emphasis on the Federal Procurement Standards of “Super Circular” 2 CFR 200 and the required affirmative steps for contracting with small and minority business, women’s business enterprises, and labor surplus area firms.

It is strongly recommended that existing contracts local governments may have previously entered into for HGAC-CE-2012-10-001 and HP07-13, HP07-16, be replaced with the new contracts through HGACBuy.
